Ford Faces Class Action Over $1.3 Billion Tariff Refund - Buyers Say They Deserve a Cut

Nobody wants to overpay for a new car. But finding out after the deal is done that the automaker could claw back those added costs, while you’re left holding the bag, feels like a raw deal. That’s the heart of a new proposed class action against Ford, filed in federal court in Michigan by California resident Jason Bullock.

Bullock says he paid a premium for his Mexico-built Ford Mustang Mach-E earlier this year because tariff expenses were baked into the sticker price and destination charges. S. Supreme Court struck them down months ago. That ruling means companies that paid those duties are now in line for massive refunds from the government.

3 billion from recovering tariffs paid between March 2025 and February 2026.

The lawsuit argues Ford shouldn’t be allowed to pocket both the higher prices it charged during the tariff period and the refunds it receives afterward. “If Ford retains the tariff refunds while also retaining the tariff-related price increases paid by consumers. Ford will receive a double recovery and unjust windfall,” the complaint states.

Ford hasn’t addressed the legal arguments directly but confirmed it’s reviewing the case.

This case could ripple across the industry. General Motors and Stellantis have also indicated they expect tariff-related reimbursements, raising the possibility of similar lawsuits. If a court agrees the extra costs were passed on to buyers, automakers could face payouts long after the tariffs themselves have disappeared.
